Wills, Trusts, Probate and Tax

We advise on all aspects of Wills, Probate, Trusts and related Tax issues. Our specialist Will writers adhere to the principles of promoting the highest standards within the Will writing profession. From drafting or re-writing a Will to setting up a Trust, we offer effective advice aiming to preserve capital from Inheritance Tax.

Wills Drawing up a Will provides you with the knowledge that, in the event of your death, your wishes can be acted on promptly. It ensures that the distribution of your assets can be undertaken swiftly and efficiently to provide security for your family. Without a Will you will die intestate, which could well have serious implications for your loved ones. We offer a cost-effective service and can offer home visits to suit your needs.

The Elderly Client Trusts provide great scope to pass on assets or reduce tax liability by placing the asset outside the estate. We can act as Trustees on your behalf or draft Trust documentation to place the Trusteeship with your nominees.

If your health is poor or your mental capacity prohibits you from attending to your affairs and business, Powers of Attorney and Lasting Powers of Attorney (‘LPA’) allow you to place the administration of your affairs with an ‘Attorney’. A LPA provides the flexibility to deal with matters while you are able or willing to do so.

Probate and Administration of Estates on Death Our Probate practitioners provide advice with sensitivity and understanding when administrating estates. They can establish whether it is necessary to obtain a Grant of Probate or Letters of Administration to allow assets to be collected and distributed in accordance with the wishes of the deceased. Our service includes tax advice to ensure the estate is passed on to the beneficiaries as efficiently as possible.

Tax Our experts can advise on a range of tax planning options for reducing your estate's potential liability for Inheritance Tax. The current inheritance tax (‘IHT’) threshold is £325,000 per person. This means that anything above £325K will be taxed at 40%. We regularly advise clients on estate planning in order to mitigate IHT.

We advise on all aspects of:

  • Wills* – including Single Wills, Mirror Wills and Codicils
  • Trust Wills - Property Trust, Flexible Life Interest Trust, Discretionary Trust and Disabled Discretionary Trust
  • Trusts and Trustees, Personal Representatives (Executors) and their duties
  • Probate and Estate Administration
  • Beneficiaries – Beneficiaries of Gifts and Residuary Beneficiaries
  • Guardians
  • Intestacy in England & Wales
  • Lasting Powers of Attorney
  • Tax Planning
  • Court of Protection
  • Contentious Trusts and Estates

*Our fees for basic Wills start from

  • £250 for a single basic Will
  • £400 for a pair of basic mirror Wills and
  • £80 for a Codicil

Note that a ‘basic’ or ‘simple’ Will is considered to be one in which you are leaving your estate to a limited number of people and the value of your estate does not require complex legal or tax advice. In each case, we will review the information provided and advise you if a basic Will is suitable and/ or advise on other suitable estate planning options if need be.

Will Aid

We are pleased to announce that we will be taking part in Will Aid this November.

We will waive our fee for drawing up a basic Will and instead invite our clients to donate to the Will Aid group of charities. The suggested minimum donation is £95 for a single basic Will and £150 for a pair of basic 'mirror' Wills.

The money raised is shared by nine well-respected Will Aid charities and is used to transform the lives of people in the UK and around the world.

Will Aid has raised over £15 million since its launch over 25 years ago and an estimated £95 million has been pledged as legacies by people making their Will through the scheme.

Having an up to date and properly written Will is the only way to be sure that your assets will be distributed according to your wishes. It is also the only certain way to avoid difficulties for your family and friends after your death. By making a Will with Will Aid you will be protecting your loved ones’ future and helping to raise money to support the vital work of the Will Aid charities.
